Tyrolean Ski and Snowboard School Horn / Kitzbühel Lukas Hübl

Scope of the Terms and Conditions:

For business relationships between the Ski School Horn - Tyrolean Ski and Snowboard School Horn / Kitzbühel Lukas Hübl, hereinafter referred to as "Ski School Horn", and the course participant, hereinafter referred to as "Customer", the following General Terms and Conditions, hereinafter referred to as "GTC", in the respective valid version apply exclusively. The valid version of the GTC depends on the time of the respective booking.

1. Bookings

1.1 By making your oral or written booking at the Ski School Horn or one of our sales outlets, a contract is concluded between you and the Ski School Horn as the organizer. By making your booking, you accept these general terms and conditions as part of the contract between you and the organizer.

2. Our Services

2.1 You can find the scope of the contractual services in the description of our offers as well as in the information in our confirmation/invoice.

2.2 Lift tickets, travel expenses, bus or taxi transfers, as well as meals and drinks, are not included.

2.3 Special requests can be considered by agreement with the organizer. Any additional costs will be borne by the customer.

3. Liability

3.1 Each participant in the courses and tours of the Ski School Horn is aware that he/she is participating in an adventure activity that cannot provide the comfort and safety of a typical package tour. The particular dangers and risks in the mountains are diverse and therefore cannot be completely excluded. By making your booking, you acknowledge these dangers and risks. Liability for all damages and claims against the Ski School Horn and the ski instructors, ski guides, is limited to gross negligence and intent.

3.2 Insurance coverage is the responsibility of the participant. The conclusion of comprehensive, valid accident and health insurance, which also includes rescue costs, is required.

3.3 The organizer is entitled to use the services of third parties for optimal service provision. The Ski School Horn is not liable for acts, omissions, or failures of third-party providers.

4. Program Changes

4.1 In case of uncertain weather conditions, we reserve the right to change the program and make changes to the location for safety reasons. The participant agrees to this by making the booking. Any additional costs that may arise will be borne by the participant.

5. Cancellation by the Customer

5.1 The customer can withdraw from the contract at any time before the execution of an activity or tour. The date of the written declaration of withdrawal to the organizer is decisive. In case of accident or illness, the unused course days will be refunded upon presentation of a medical certificate issued by a practicing doctor or hospital from the region. Weather-related restrictions, bad weather, avalanche danger, etc., do not entitle to a refund. If a course or lesson cannot be held due to the failure of the ski lifts, the lesson will be credited to you.

5.2 The following cancellation fees will be charged in case of withdrawal: 30-15 days before the start = 25% 14-8 days before the start = 50% 7-1 days before the start = 75% on the day of execution = 100% Outside these deadlines, a cancellation fee of €40 per person or a maximum of €120 per order will be charged for cancellations.

5.3 If a participant terminates the activity prematurely or does not participate at all, he/she is not entitled to a refund.

6. Cancellation by the Organizer

6.1 The organizer is entitled to cancel the activity at short notice if a course/tour cannot be carried out due to force majeure, safety concerns, or extreme weather conditions. Please note that the safe execution of the activity is in everyone's interest. In this case, we will endeavor to offer you an alternative date. Otherwise, payments already made will be refunded. Further liability cannot be assumed.

6.2 The ski instructor, ski guide, is entitled to exclude participants who violate our terms and conditions, especially those who do not meet the necessary requirements for the tour, from the tour or to terminate it. In this case, there is no entitlement to a refund.

6.3 All group courses/tours require a minimum number of participants. If the minimum number of participants is not reached, the organizer can withdraw from the contract up to two days before the course/tour. Further claims are excluded.

7. Participation Conditions

7.1 Each participant assures that he/she possesses the physical and mental prerequisites necessary for the selected tour, as stated in the tour description. Participants are obliged to inform the organizer of any health problems. Please note that the consumption of alcoholic beverages, drugs, or other consciousness-altering substances before or during the activity is prohibited. Participants must strictly adhere to the organizer's participation conditions and the instructions of the tour guides and local staff. In case of disregard, the organizer reserves the right to exclude errant groups or individuals from the activity. There is no entitlement to a refund in this case.

8. Payment Terms

8.1 The booked activities are to be paid in advance. If the booking is made 30 days or more before the start of the corresponding activity, a deposit of 50% is due upon receipt of our confirmation/invoice. The remaining payment must be made no later than 20 days before the start of the activity. For bookings made less than 20 days before the start of the activity, the total amount is due immediately. Failure to make timely payments entitles the organizer to withdraw from the contract. Any cancellation fees will be charged to the customer in accordance with clause 5.2.

9. Jurisdiction

9.1 The exclusive place of jurisdiction is Kitzbühel. Austrian law applies.

Payment

Credit card payments to the ski school are processed by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement. The domain where you enter and process your payment is owned by TREKKSOFT and operated by TREKKSOFT.
